SCO v. IBM: Encyclopedia II - SCO v. IBM - SCO's claims

SCO's lawsuit has been consistent only in its claim of breach of contract (since the abandonment in early 2004 of its claim of misappropriation of trade secrets). SCO's initial claims were: Misappropriation of trade secrets Unfair competition Interference with contract Breach of IBM Software Agreement On July 22, 2003, SCO amended its complaint. It added two new claims: Breach of IBM Sublicensing Agreement ...

SCO v. IBM: Encyclopedia II - USL v. BSDi - Pretrial

Since the allegedly infringing software had been released to the public by the UC Berkeley, most of the case would hinge on events there. Because UC Berkeley was not originally a party to the suit, the University made its arguments against an injuction in a series of amicus briefs. The University submitted the licenses UC Berkeley had from AT&T for UNIX, which specifically stated that the copyright on the Berkeley software built upon the 32V version of UNIX belonged to the University. They went on to claim that AT&T had confir ...

SCO v. IBM: Encyclopedia II - USL v. BSDi - USL's complaint

In the lawsuit, UNIX System Labs alleged that: The Regents of the University of California, by releasing NET-2 "based upon, substantially copied from, or derived from proprietary UNIX": Had violated USL's software license with the UC Berkeley . Had violated USL's copyright on UNIX. Had divulged USL's trade secrets by making public "the methods or concepts used therein". BSDi had known UC Berkeley had no right to release the NET-2 source code (and had in fact induced the University ...

SCO v. IBM: Encyclopedia II - USL v. BSDi - Background

The suit has its roots at the Computer Sciences Research Group (CSRG) at the University of California, Berkeley, which had a license for the source code of UNIX from AT&T's Bell Labs. Students doing Operating systems research at the CSRG modified and extended UNIX, and the CSRG made several releases of the modified operating system beginning in 1978, with AT&T's blessing. Because this Berkeley Software Distribution (BSD) contained copyrighted AT&T UNIX source code it was only available to organizations with a s ...

SCO v. IBM: Encyclopedia II - USL v. BSDi - Terms of the settlement

Until recently, the details of the settlement have been kept secret between the parties, with the general public consensus being that USL and BSDi had mutually agreed not to litigate further over the software that would later be developed into the free BSDs -- an agreement reached after the judge denied the injunction against BSDi, and after the UNIX IP had been purchased from AT&T by Novell. In November 2004, a copy of the USL v. BSDi settlement agreement was posted to the Groklaw website, obtained from The Regents of the University of ...

Caldera Systems, based in Utah, was founded in 1994 by Ransom Love, and received start-up funding from Ray Noorda. Its main product was Caldera Linux, a Linux distribution mainly targeted at business customers and containing some proprietary additions. SCO v. IBM: Encyclopedia II - Slashdot subculture - Recurring jokes

Reflecting the speed of contemporary pop culture in general and Internet phenomena in particular, many of Slashdot's recurring jokes enjoy brief shelf-lives. Some posters, aware of Slashdot's trolling subculture, often deliberately set out to create and propagate new memes, hoping to make a new joke catch on. A poster will sometimes combine several well-known jokes, including many of those listed below, into one "super-cliche." A successful attempt produces a post that is either quite funny or incredibly annoying, depending on a reader's perspective, and is almost always n ...

SCO v. IBM: Encyclopedia II - SCO-Linux controversies - Background

At the beginning of 2003, SCO claimed that there had been "misappropriation of its UNIX System V code into Linux". However, the company refused to identify the specific segments of code, claiming that it was a secret which they would only reveal to the court. They did say that the code could be found in the SMP, RCU and a few other parts of the Linux kernel. They later announced that they were suing IBM for $1 billion, claiming that IBM transferred SCO trade secrets into Linux. That amount l ...

SCO v. IBM: Encyclopedia II - AIX operating system - Development

AIX V1, introduced in 1986, was based on System V Release 3. IBM later ported AIX to the RS/6000 platform as AIX/6000; since 1989, AIX has served as the RS/6000's primary operating system. In developing AIX, IBM and INTERACTIVE Systems Corporation (whom IBM contracted) also incorporated source code from Berkeley Software Distribution 4.2 and 4.3. In the SCO v. IBM lawsuit filed in 2003, the SCO Group alleged that (among other infractions) IBM misappropriated licensed source code from UNIX System V Release 4 for incorporation into AI ...

SCO v. IBM: Encyclopedia II - Sequent Computer Systems - History

Sequent formed in 1983 when a group of seventeen engineers and executives (including Scott Gibson) left Intel after the failed iAPX 432 "mainframe on a chip" project was cancelled. One non Intel employee joined them. They started Sequent to develop a line of SMP computers, then considered one of the up-and-coming fields in computer design. Several engineers from AT&T Bell Labs also came over, bringing systems programming expertise. Sequent's first computer systems were the Balance 8000 and Balance 21000 released in 1984. The Balan ...

SCO v. IBM: Encyclopedia II - Tarantella Inc. - Tarantella the product

In 1993 SCO acquired IXI Limited, a software company in Cambridge, UK, best known for its X.desktop product. In 1994 it then bought Visionware, of Leeds, UK, developers of XVision. In 1995 the development teams from IXI and Visionware were combined to form IXI Visionware, later the Client Integration Division of SCO. The Client Integration Division was relatively independent of the rest of SCO. Specialising in software to integrate Microsoft Windows and UNIX systems, it retained its own web site for some time and ported its sof ...

SCO v. IBM: Encyclopedia II - Google bomb - Background

An example of Google bombing, if a user registers many domains and all of them link to a main site with the text "... is a living legend" then searching for "living legend" on Google will return the main site higher in the ranking, even if the phrase "living legend" doesn't appear on the main site. A common means of exploiting this is through weblogs, where although the entry may disappear from the main page quickly, the short-term effects of a link can dramatically affect the ranking of a given site. Empirical results indicate that it does not take a large number of websites to achieve a Googlebomb. The effect has been achieved ...
