2004 U.S. election voting controversies - Voter registration.
Facilitating voter registration was the main goal of the National Voter Registration Act of 1993. States were required to make registration more widely available, notably through driver's license agencies (hence the nickname "Motor Voter Act"). In 2004, however, there were incidents in several states in which people who had submi ...

 | | | Florida Central Voter File: Encyclopedia II - 2004 U.S. presidential election controversy vote suppression - Voting machine shortagesLong lines at voting stations are suggested by some as a way in which voting was selectively suppressed. By making it more time consuming to vote, voting is claimed to have been deterred more in some locations than others, and that the impact was to selectively deter voters in high-population areas which were known to be principally Democratic.
Long lines, though seemingly benign, were a problem with the 2004 election. In many places, lines were over 6 hours long. Two causes contributed to this:

 | | | Florida Central Voter File: Encyclopedia II - 2004 U.S. presidential election controversy vote suppression - Purges of voter listsState efforts to purge voter rolls have led to disputes, notably in Florida. Before the 2000 election, Florida officials purged scores of thousands of registered voters on the grounds that they were convicted felons (and therefore ineligible under Florida law). Many of those whose names were purged were “false positives” (not actually felons). (See Florida Central Voter File.) A post-election lawsuit brought by the NAACP and other organizations resulted in a settlement in which the state ag ...

One instance of calling voters with erroneous polling information triggered a lawsuit filed by the Ohio Republican party against the Ohio Democratic Party, Greene County Democratic Party and ACT Ohio, a 527 political action committee. The suit claimed that Democrats misinformed Republicans about the date of the election and told them certain documentation would be needed to vote. A te ...

 | | | Florida Central Voter File: Encyclopedia II - 2004 U.S. presidential election controversy vote suppression - Provisional ballotsProvisional ballots are for would-be voters who assert that they are registered but whose names cannot be found in the list available at the polling place. The voter completes a written ballot, which is placed in a sealed envelope. The ballot is opened and counted only if the voter is subsequently found to be registered.
In 2004, there was contention over the standards for determining whether to count provisional ballots. In several states, officials said that they would not count provisional ballots, even those from properly register ...

Others, however, by accident or (it is charged) by design, have disproportionately affected racial minorities. For example, the U.S. Commission on Civil Rights determined that, in Florida in 2000, 54 percent of the ballots discarded as "spoiled" were cast by African Americans, who were only 11 percent of the voters. | | | Florida Central Voter File: Encyclopedia II - 2004 U.S. presidential election controversy vote suppression - Absentee ballotsAbsentee ballots were also an issue. There were reports of absentee ballots being mailed out too late for most voters to complete and return them in time. (In some instances, officials argued that last-minute litigation over Ralph Nader’s ballot status or other issues had prevented them from finalizing the absentee ballots as early as they wanted to.) In Broward County, Florida, some 58,000 absentee ballots were delivered to the Postal Service to be mailed to voters, acc ...

 | | | Florida Central Voter File: Encyclopedia II - Florida Central Voter File - AppealsIn time, an appeals process was instituted, but in some cases it required ordinary citizens to be fingerprinted in order to prove they were not the felons they were accused of being. In the end, out of 4,847 people who appealed, 2,430 were judged not to be convicted felons. As Civil Rights Commission attorney Bernard Quarterman put it during testimony in Miami on February 16, "They were guilty until proven innocent". At least 108 legitimate voters were not purged from the list until after the election.
Some voters on the list did not receive advance notice that they were ineligible to vote until they appeared at the polls ...

 | | | Florida Central Voter File: Encyclopedia II - Florida Central Voter File - Election law violations allegations lawsuitsThe severe problems with the list, and the process by which it was manufactured and deployed, as well as other issues related to the 2000 election controversy in Florida, became the subject of much criticism and allegations of fraud, which resulted in investigations, litigation, and reform measures.
Phyllis Hampton, general counsel of the Florida Elections Commission, testified that her office could investigate the wrongful removal of a Floridian from the voter rolls if there was evidence of a willful violation. | | | Florida Central Voter File: Encyclopedia II - Florida Central Voter File - Problems in the cleansing processAt first, Florida specified only exact matches on names, birthdates and genders to identify voters as felons. However, state records reveal a memo dated March 1999 from Emmett "Bucky" Mitchell, a lawyer for the state elections office who was supervising the felon purge, asking DBT to loosen its criteria for acceptable matches. When DBT representatives warned Mitchell that this would yield a large proportion of false positives (mismatches), Mitchell's reply was t ...

 | | | Florida Central Voter File: Encyclopedia II - Florida Central Voter File - Private involvementWhat makes the Central Voter File remarkable is that Florida is the only state that pays a private company to "cleanse" voter rolls. In 1998, the first firm hired for this program was Professional Service Inc., which charged $5,700 for the job.
There was an open bid for the job, which was assigned to DBT Online's, despite the fact that its bid was the highest-priced (several thousand percent over competitors). The state gave the job to DBT for a first year fee of $2,317,800. In the files about the DBT bid there appears a handwritten note which reads "don't need" next to the listing of v ...

Together the lists comprised nearly 1 % of Florida's electorate and nearly 3 % of its African-American voters.
